Terms of Service

Please read these terms carefully before using MBS Workbench.

Effective Date: March 18, 2026 — Updated for Phase 60+61 features

1. Introduction & Acceptance

These Terms of Service ("Terms") govern your use of MBS Workbench ("the Software"), developed and published by MBS InfoSolutions ("we", "us", "our"). By downloading, installing, or using the Software, you agree to be bound by these Terms. If you do not agree, do not use the Software.

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use MBS Workbench on devices you own or control, for personal or professional development purposes.

Free Tier

The free version of MBS Workbench may be used without charge. Certain features may be reserved for paid tiers. We reserve the right to modify the scope of the free tier at any time.

Paid Tiers (Premium, Team, Enterprise)

Paid subscriptions unlock additional features as described on our website. Subscription terms, pricing, and feature inclusions are subject to change. Active subscribers will be notified of material changes in advance.

3. Beta & Early Access

MBS Workbench is currently offered as a beta / early access product. This means:

  • Features may be incomplete, experimental, or subject to change without notice.
  • The Software may contain bugs or defects that could affect its operation.
  • No uptime, availability, or performance guarantees are provided during the beta period.
  • We may reset, modify, or discontinue features at our discretion.

By participating in the beta program, you acknowledge and accept these conditions.

4. User Accounts & License Keys

Certain features of MBS Workbench may require a license key for activation. License keys are personal and non-transferable. You agree not to:

  • Share, redistribute, or sell your license key to third parties.
  • Use automated means to generate or obtain license keys.
  • Circumvent or tamper with the license validation mechanism.

We reserve the right to revoke license keys that are used in violation of these Terms.

5. Acceptable Use & Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except as expressly permitted by applicable law.
  • Modify, adapt, translate, or create derivative works based on the Software.
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
  • Use the Software to develop a competing product or service.
  • Redistribute, sublicense, lease, rent, or lend the Software to third parties.
  • Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to interfere with or disrupt the integrity or performance of the Software.

6. Intellectual Property

MBS Workbench, including its design, code, documentation, branding, and all related materials, is the exclusive intellectual property of MBS InfoSolutions. These Terms do not transfer any ownership rights to you.

Content you create using the Software (your code, models, generated images, trained adapters, project files) remains your property. We claim no ownership over user-generated content.

7. Third-Party Models & Services

MBS Workbench allows integration with third-party services, including but not limited to:

  • HuggingFace (model downloads)
  • Cloud API providers (OpenAI, Anthropic, Google, AWS Bedrock, DeepSeek, Groq, Mistral, etc.)
  • Cloud GPU providers (Vast.ai, RunPod, Lambda Labs, etc.)
  • MCP protocol servers (databases, blockchains, game engines, etc.)
  • Export/deployment targets (Docker, Kubernetes, AWS, Azure, GCP, Vercel, Netlify)

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services. When you use cloud APIs or GPU providers, your data is transmitted according to their privacy policies — not ours.

AI models downloaded or used through the Software are subject to their respective licenses (e.g., Apache 2.0, Llama Community License). You are responsible for ensuring compliance with the license terms of any model you download or use. Models used for inference remain on your local device; training data used for LoRA fine-tuning is stored locally.

Phase 61 Export Features: You may export model configurations as Docker Compose files or Python inference clients. These exports are generated locally and are your responsibility to deploy and secure.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated output (code, text, images) is produced by machine learning models and may be inaccurate, incomplete, or unsuitable for your intended purpose. You are solely responsible for reviewing, testing, and validating any AI-generated content before use in production.

Autonomous agent operations (Phase 61 Agent Loops) may modify files, execute terminal commands, or perform Git operations. Agents operate under a three-tier safety system and may require human approval for destructive operations. You remain responsible for all actions performed by agents on your behalf.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MBS INFOSOLUTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Software.
  • Any output, content, or results produced by the Software or integrated AI models.
  • Unauthorized access to or alteration of your data or transmissions.
  • Any third-party conduct or content accessed through the Software.

Our total aggregate liability for any claims arising out of these Terms shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

10. Termination

We may terminate or suspend your access to the Software at any time, with or without cause, and with or without notice. Upon termination:

  • Your license to use the Software is immediately revoked.
  • You must uninstall and destroy all copies of the Software in your possession.
  • Your local data (projects, models, settings) remains on your device and is not affected.

Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

12. Telemetry & Observability (Phase 60 Feature)

MBS Workbench includes observability features (DeveloperDashboard, daemon logs, performance metrics) that run entirely locally. You have full control over telemetry collection:

  • Telemetry Opt-In: On first launch, you are prompted to opt-in or opt-out of telemetry. Your choice is persisted locally.
  • Local Observability: Daemon status, logs, and performance metrics are stored in ~/.mbs/ and are never transmitted without explicit consent.
  • Terminal Context: Terminal environment variables ($MBS_HOST, $MBS_PORT, $MBS_WORKSPACE) are injected locally for seamless IDE integration and are not logged externally.

If you opt-in to telemetry, only non-identifiable event data (feature usage counts, error types, version info) may be transmitted to improve the product. No code, prompts, or project data is ever included.
